AGICOA Europe
Dec. 07 - public declaration

On December 11, AGICOA Europe, AGICOA's partner organization based in Luxembourg, held its first Board of Directors' meeting.

John M. Jacobsen, the President of AGICOA Europe has nominated its executive committee and André Chabeau was designated as Managing Director.

AGICOA Europe is a collecting society domiciled in Luxembourg to facilitate AGICOA's activities in certain European Union member countries thanks to the principle of the free movement of services and freedom of establishment within the Union.


Sep. 07 - a programmed birth

The creation of the European clone of AGICOA is planned for the first quarter of 2008.

To anticipate possible changes in the European legislation pertaining to collective management, the sister organization will be domiciled in Luxembourg, in the heart of the European Community. Its status will be that of a collecting society subject to the laws of the country of localization. It structure, governance and constitution will obey the same rules as in the case of AGICOA.

 

Albania
Nov. 07 - first collections

Several licensing agreements have been signed in Albania in 2005. Although certain cable operators have not yet honored their commitments, the first collections did take place in 2007. The potential for royalties is still limited and the amounts collected by AGICOA will be allocated to a mark-up distribution at the end of the year.


Feb. 06 - illegal activities

Apart from Alfakabel, no other Albanian cable operators accepted to conclude licensing agreements. AGICOA and ALBAUTOR are currently in contact with the local Broadcasting council in order to shut down these illegal activities.


Mar. 05 - first agreements signed

AGICOA has been building an alliance with the Albanian CISAC collecting society ALBAUTOR and the EBU broadcaster in view of concluding a global licensing agreement in Albania.

First agreements were signed with Alfakabel. Negotiations with additional cable-operators are going on.

 

Australia
Sep. 07 - declaration in favor of AGICOA Rightsholders
Last September, AGICOA has issued to Screenrights (the Australian audiovisual copyright society and AGICOA's Member) its first declaration of rights on behalf of its Rightsholders and pertaining to the Australian territory.

The first collections are expected to take place in year 2008.


May 06 - court settlement
In the absence of any agreement on applicable rates between Screenrights (the Australian audiovisual copyright society and AGICOA's Member) and the national cable operators, the Copyright Tribunal has finally settled the issue and set the tariff rates.


Feb. 06 - now expected for the summer 2006
The ruling of the Copyright Tribunal which will set a rate for the retransmission of free to air TV channels in Australia first expected last fall will certainly be rendered in summer 2006.

In the meantime Screenrights (the Australian audiovisual copyright society and AGICOA's Member) and AGICOA are making progress in building up a close cooperation with regard to the distribution of the Australian royalties.


May 05 - awaiting a ruling on tariffs
In order to establish the specific framework of collective management in Australia after its ratification at the end of 2003, several audiences organized by the court of the competent jurisdiction were held in 2004 and continue in 2005. A ruling setting the tariff to be applied for retransmission of TV programs is expected this coming fall. It will make it possible for Screenrights (the Australian audiovisual copyright society and AGICOA's Member) and for AGICOA to organize the related management.

The two companies have decided to enter into partnership and are right now preparing a rigorous planning taking into consideration the Australian market specificities.


Oct. 04 - it might be for 2005
The first instance ruling on the clarification of the copyrights legislation in Australia has been postponed to mid 2005. This country could become a significant market for cable retransmission royalties. AGICOA is working in close cooperation with Screenrights (the Australian audiovisual copyright society and AGICOA's Member) to achieve proper collection in this country.

July 04 - a new continent for AGICOA
After the positive outcome of a lawsuit expected for this autumn on the clarification of the copyright legislation in Australia, this country could become a significant market for cable retransmission royalties. AGICOA is working in close cooperation with Screenrights (the Australian audiovisual copyright society and AGICOA's Member) to achieve proper collection in this country.

 

Austria
Nov. 07 - back in business
The dispute relative to the respective shares of the producers (represented by VAM, the Austrian collecting society) and of the authors (represented by WDS) has been settled. Distributions in Austria will once again take place during the year 2008.

Apr. 05 - new member
Last April, VAM, the Austrian collecting society, with which AGICOA has been collaborating for many years, became Member of our Association. After SUISSIMAGE in 2002, the affiliation of VAM illustrates perfectly the spirit of co-operation which governs the relations of AGICOA with other national collecting societies.

Feb. 02 - producer's share rises
VAM, the Austrian collecting society, with which collaborates AGICOA, won an arbitration granting the producers' share a 45% increase in Austria. Even if the raise is spectacular, it should be replaced in its context as this growth will place the producers' share to 20% whereas it represents 35% in most other countries.

 

Belgium
Apr. 07- additional agreements
The initial agreement drawn with RTD/Cable Belgium, the organization that brings together all cable operator companies in Belgium, has been supplemented with new agreements with additional operators such as Belgacom and INDI.

The contract with INDI represents the first instance of an agreement reached by AGICOA in Belgium relative to digital cable retransmission rights.


Oct. 06 - denial of copyright
Telenet, an analogical and digital cable operator, has re-opened an old debate at the Mechelen Court of First Instance, by questioning remuneration of cable retransmissions of audiovisual works. Telenet claims it does not need to acquire retransmission rights because in its opinion, in the all digital era, cable operators merely act as technical "pipelines".

Such arguments put forward by cable operators today are the same as those dating back to the seventies and pertaining to copyright preservation in case of cable retransmission. The claims made at the time were rejected both by the European Court of Justice and different national courts.

For AGICOA, the underlying principle of copyright is simple: any entity that uses protected works in the context of its economic activity must be authorized to do so by the Rightsholders and must pay corresponding royalties.


Feb. 06 - satisfactorily
Licensing agreements are running satisfactorily in Belgium where a first contract has been signed with Belgacom and where promising negotiations are underway with cable operators who launched digital retransmissions.

Jan. 06 - negotiations
Satellite retransmission rights in Belgium are the focus of ongoing negotiations between AGICOA and
TV Vlaanderen.

July 04 - smoothly
Collections in Belgium are running smoothly and the agreements made with the cable operators are respected.

Sep. 03 - 37 million EURO distributed
The payments of royalties recovered for the years 1996 to 2002 have taken place since the beginning of 2003. Some 37 million EURO were distributed to their Rightsholders through AGICOA Belgium in Brussels. No fees have been deducted from these amounts to compensate the late recovery of these royalties.

July 03 - a new era
"The signature of a new contract with the Belgium cable operators late 2002 had been a great satisfaction. Now that an agreement, regarding the retransmission of three commercial channels in Belgium, has also finally been concluded between RTD on the one hand and AGICOA Belgium and AGICOA on the other, we hope that a new era of ongoing and smooth distributions will be possible for this country." said André Chaubeau Managing Director of AGICOA.

Nov. 02 - copyrights win
These are some 45 million EURO, related to royalties due from 1996 to 2002, that Belgium cable operators finally paid back to AGICOA on November 29 after seven years of dispute.

A new contract has also been signed for the period from 2003 to 2005 and this is a great satisfaction, commented Hein Endlich who headed the various meetings prior to this satisfactory outcome.

The former AGICOA Managing Director outlined this was before all a success for all related rightsholders for whom AGICOA will process to a special remuneration early 2003.

 

Bosnia-Herzegovina
Sep. 06 - expanded agreements
In Bosnia, existing global license agreements covering public TV channels from different countries and several commercial German channels have been expanded to include the other channels retransmitted in this country.

The global amounts collected in Bosnia will be allocated to a mark-up distribution.


Feb. 06 - extended for three years
The existing global licensing agreements have been extended for three years (2006 to 2008) with a substantial tariff increase.

July 04 - first collections started
Several licensing agreements have been signed between November 2003 and June 2004 in Bosnia-Herzegovina. Even if the 2004 royalty potentials remain marginal, the fact that the first collections started earlier this summer is encouraging.

July 03 - talks with local cable operators
The successful business relationship established by AGICOA in Slovenia with one of the main cable operators ELTA - also operating in Bosnia-Herzegovina - may lead to a global licensing agreement in this later country.

AGICOA, also acting on behalf of the local music collecting society and the broadcasters represented by VG Media and EBU, has recently transmitted the draft of a global licensing agreement to the cable operators gathered under ELTA's banner.

 

Bulgaria
Nov. 07 - difficulties remain
In spite of ongoing collections, the situation in Bulgaria remains difficult. Several Bulgarian cable operators continue to violate the terms of the global agreement signed in 1999. The legal action taken against these operators by AGICOA has failed so far to produce any results.

The royalties collected by AGICOA in Bulgaria will be allocated to a mark-up distribution at the end of the year.


Aug. 05 - higher coverage targeted
Two of the court proceedings initiated by AGICOA against cable operators who stopped paying due cable royalties ended up with settlement agreements, while the third one is on appeal. Collection has started again but it appears more and more clearly that the global licensing agreement signed in 1999 does not - by far - cover the entire Bulgarian cable market.

First because this market is composed of several hundreds of cable operators spread all over the country and difficult to federate. Second because the existing licensing agreement is meant for copyrights of broadcasts retransmitted by foreign channels on the Bulgarian territory, whereas most channels retransmitted there are foreign commercial networks or of Bulgarian origin.

In order to achieve a higher coverage in this country, and after unsuccessful negotiations with cable operators, AGICOA and Filmautor (AGICOA local Partner) are preparing for litigation.

Consequently AGICOA has contacted its Rightsholders to get their written confirmation that it is duly mandated by them to exert their respective cable retransmission royalties in Bulgaria.


Dec. 04 - nothing solved yet
In the last years, AGICOA initiated legal proceedings against several cable operators in Bulgaria as they did not respect the global licensing agreement signed in 1999. Procedural heaviness and constraints do not facilitate the complexity of the situation which is not solved yet.

June 03 - to save the agreement
Still awaiting first instance rulings expected for late 2003, AGICOA - heading a joint national and international rightsholders committee - tried to resume talks with local cable operators that have now stopped the retransmission of international channels that are part of the existing global licensing agreement.

In parallel, the committee met with four different state bodies in order to convince them of the need to intervene in cable market.

The result is that cable operators insist on an unacceptable 50% discount on agreed upon tariff, whereas the seconds keep referring to - and only referring to - the pending court proceedings.

AGICOA is now studying ways to save the once well running global licensing agreement.


Mar. 03 - pending rulings
The rulings of the legal proceedings started early 2002 against three cable operators are not expected before the end of 2003 as the court has still not been able to consult the lawsuit material.

Mar. 02 - legal proceedings
As the delay set to restart payment of the cable royalties under the existing global licensing agreement is over, AGICOA, EBU and VPRT, together with the local collecting societies involved, decided to start legal proceedings against three cable operators.

 

China
Feb. 06 - Collection framework to develop
There is a real market potential for the collection of retransmission royalties in China but the framework of legal and commercial relations between producers, TV channels and cable operators still needs to be developed until collections become a reality.

In that perspective, the China film producers association became a member of AGICOA in 2005. They later on created the China Film Copyright Protection Association and received the state authorization to run a collecting society.

Right now both Chinese organizations and AGICOA are dealing with the registration of their members' retransmission rights in Europe and with legal and commercial advice for the future collecting activities of the China Film Copyright Protection Association in China.


July 05 - new member
The China Film Producers' Association became a Member of AGICOA.

 

Croatia
Dec. 07 - first royalties finally collected
After the signing of a licensing agreement in February 2006, the first royalties covering years 2003 through 2006 are finally being collected.

Feb. 06 - global licensing
After the conclusion of the global licensing agreement with DCM, the by far biggest cable operator in Croatia, other smaller cable operators followed and the market coverage reaches today about 80% of all cable households in Croatia.

Aug. 03 - meeting with local cable operators
Supported by the broadcasters' organizations, EBU and VG Media, AGICOA will be organizing a meeting in September with the Croatian cable operators in view of implementing there a global licensing agreement.

 

Denmark
Nov. 07 - stable
In Denmark, the situation remains stable and royalties are collected regularly.

June 07 - a new member
CAB, the Danish collecting company with which AGICOA has been collaborating for many years, has become one if its latest members.

 

Digital retransmission
Oct. 07 - common declaration
The historical solidarity between the different types of Rightsholders was reinstated in the form of a common declaration made by AGICOA, CISAC (International Confederation of Authors and Composers Societies), EBU and VG Media (broadcasting organizations).

The four organizations consider this common declaration as an official response to the intense lobbying of cable operators in the context of global digital conversion. This lobbying is aimed at attempting to revive an old thesis dating back to the seventies and that was turned down by the European Court of Justice a long time ago.


Feb. 07 - European commission
In a document released in 2006 with the help of Solon Management Consulting, a German consulting firm, operators claim that with the advent of digital retransmissions they do not have to continue to remunerate work retransmission.

AGICOA's position on this issue remains clear and immutable. It is the same as that of the European Court of Justice and national courts dating back to the seventies. In those years, the cable-operators argued they did not have to pay for content retransmitted by cable and the courts replied that not paying in this context was theft and should be treated as such. This has indeed been AGICOA's position all these years and it has not changed today.

As a response to the operators' biased interpretation of copyright, AGICOA presented to the European Commission an objective and factual account aimed at restoring the fact that the principle underlying copyright is not the technology of retransmission but indeed the true economic value generated by the actual use of the copyrighted work.

 

Educational copying
Jul. 07 - in the UK
AGICOA has become a member of ERA, the Educational Recording Agency based in the UK.

The ERA compulsory licensing scheme permits staff at educational establishments to record broadcasted programmes for non-commercial educational purposes. ERA collects royalties for its members for that activity.

With its affiliation, AGICOA is thus making sure that the Rightsholders who have given it an ad-hoc mandate, derive an income from the licensed use of their works in the Kingdom schools.

AGICOA and ERA recently engaged in an arbitration to have the independent producers' share rise.

 

Estonia
Sep. 06 - renewal
Current global licensing agreements covering public TV channels from different countries and several commercial German channels have been renewed in Estonia.

Negotiations are under way to expand the agreements to include other channels retransmitted in the country.

The royalties collected in Estonia will be allocated to a mark-up distribution.


Feb. 05 - all cable operators
While renewing the existing global licensing agreements, AGICOA extended them to the entire group of Estonian cable operators.

July 04 - contract running well
Renewed in 2002, the global licensing contract continues to run well.

Dec. 02 - agreement renewed
The licensing agreement has been renewed and is running satisfactorily.

 

Finland
May 05 - new member
TUOTOS/AGICOA Finland ry became a Member of AGICOA.

Feb. 05 - producers' share scrutinized
AGICOA and its local partner TUOTOS AGICOA Finland are still negotiating the raise of the producers' share with KOPIOSTO (the national collecting society).

July 04 -
The first round of negotiations with KOPIOSTO (the national collecting society) to raise the producers' share in Finland did not reach any results so far. AGICOA and its partner TUOTOS have been invited for new talks at the end of July by the collecting society.

Sep. 03 - attacking the limited producers' share
Now supported by its new partnership with TUOTOS, it is nonetheless still through KOPIOSTO that AGICOA will collect royalties in Finland. The new alliance has started attacking the somehow limited share actually allocated to producers and had a first round of negotiations with KOPIOSTO in September.

July 03 - a strong alliance
In Finland, KOPIOSTO (the national collecting society) negotiates tariffs with local cable operators and determines the various rightsholders' shares (producers, authors, composers, broadcasters, etc …).

To maximize the representation of its Rightsholders in this country, AGICOA concluded a cooperation agreement with local based collecting society TUOTOS. AGICOA and TUOTOS now constitute a strong representative for the producers in Finland.

 

France
Nov. 07 - ADSL coverage almost complete
Licensing agreements have been reached by AGICOA, ANGOA (the French collecting company) and the majority of ADSL operators in France. The corresponding collections, which fall in the category of retransmissions assimilated to cable retransmissions, will be included in cable royalties.

May 07 - cooperation agreement signed
AGICOA and ANGOA (the French collecting company) have signed a cooperation agreement which confirms the collaboration between the two associations in collecting and distributing retransmission royalties in the French territory and in representing French producers outside of France.

Dec. 06 - agreements renewed at last

AGICOA and ANGOA (the French collecting company) have succeeded in renewing the licensing agreements for France. The situation had been stagnating in the country since the second quarter of 1999, with the majority of cable operators operating in the absence of any agreement with the producers and paying royalties equivalent to only 70% of the previously applicable rates.

The renewal of the agreements made it possible for ANGOA to collect the 1999-2005 arrears in the course of the year and to adapt the tariff structure for the period 2006-2010.


May 05 - nothing changed for French producers
ANGOA cancelled its cooperation contract with AGICOA and resigned as a Member of the AGICOA Association. A new collaboration scheme is actually under study with our former French Partner to preserve the interests of all Rightsholders in regards to royalties collected in France. It is nevertheless important to underscore that ANGOA's cancellation concerns only its institutional and associative relations with AGICOA. The current and future representation mandates of the French producers given to AGICOA through ANGOA for countries outside of France remain unchanged.

July 04 -
The French situation remains unsatisfactory. For the past four years, most cable operators have been operating outside any contract with producers and have paid them royalties of around 70% of the tariff stipulated in the former contract. This unacceptable situation cannot last for ever and the amounts still due will have to be paid.

 

Germany
Jan. 08 - renewal negotiations at a standstill
The negotiations aimed at renewing the global license agreement in Germany have yet to be completed. While the different parties continue to discuss the relevant issues, royalties are still collected, although at lower tariffs.

Feb. 06 - smoothly
The collection under the global licensing agreement runs smoothly and negotiations for its renewal are underway.

Dec. 03 -
Deutsche Telekom's termination of the collecting agreement late in 2001, following the end of the Federal operator's monopoly, troubled cable collections in Germany.

A new global licensing agreement has finally been signed at the end of 2003 and will allow to distribute to Rightsholders a yearly income of 49 M€ for the next five years as well as some 4 M€ in compensation of satellite retransmission rights use.

 

Hungary
Dec. 07 - first collections
AGICOA has started receiving royalties for retransmissions in Hungary.

The amounts collected so far are clearly insufficient but they will nevertheless be allocated to a mark-up distribution at the end of the year.

 

Iceland
Dec. 07 - first distributions
The amounts collected by AGICOA in Iceland will be allocated to a mark-up distribution at the end of the year.

Feb. 06 - new country of collection
Collections have started in Iceland after an agreement has been concluded between AGICOA and the local Icelandic collecting society IHM.

June 03 - negotiations on royalties shares
For about a year now, attempts to find a consensus among the various groups of rightsholders to set royalties shares having failed, AGICOA mandated its Icelandic Member - SIK - to start separate negotiations with Iceland Telecom which is retransmitting some 13 TV channels in this country.

 

IFPI
Apr. 03 - adapting the tariffs to the actual use
AGICOA decided to terminate its agreements with various national affiliates of IFPI - International Federation of the Phonographic Industry - in Ireland, The Netherlands, Sweden, Finland and Norway.

The Federation is collecting, among others, royalties for music videos' use on TV channels retransmitted by cable and AGICOA aims at adapting the current high tariffs to the actual use of music videos; thus increasing its Rightsholders' royalties.

 

Irish Republic
Nov. 07 - satisfactory situation and potential increases
The global licensing agreement that currently applies to the Republic of Ireland has yielded satisfactory results and royalties are collected appropriately.

At the same time, AGICOA is attempting to negotiate a new contract with BSky-B, an operator that has been retransmitting Channel 4 in this country since 2006.


Feb. 06 - smoothly
In the Irish Republic, the licensing agreements concluded back in 2003 and 2004 with NTL and Chorus, the two main cable operators, are running smoothly.

Feb. 04 -
After long negotiations, an agreement was found with NTL and Chorus to collect two million EURO in the Irish Republic on the programmes broadcasted by the two cable operators, including those of the BBC digital channels.

 

Israel
Dec. 07 - negotiations lie ahead
A ruling favorable to AGICOA was issued in the context of a litigation opposing AGICOA and cable operators in Israel since 1999. Negotiations between the two parties are likely.

Mar. 05 - nothing prior 2006

The litigation with cable operators continues and despite the fact that several court hearings took place in winter 2004 and that procedure will continue during the spring of 2005, it is unlikely that a decision will be taken prior to 2006.


July 04 -

In Israel, the litigation with cable operators continues, while they are still retransmitting a large range of channels without any remuneration to producers.


Aug. 03 - no recognition for collective management

AGICOA's legal proceedings against the Israeli cable operators for the infringement of producers' copyrights in works retransmitted as of the 90's, is still pending another Court's decision (outside AGICOA's file). This ruling that will decide on the existence or not of copyrights in cable retransmission of satellite broadcast is expected for the fall 2003.

In parallel, the Israeli Parliament did not adopt the law recognizing collective management.


Apr. 03 - pending cassation
The proceeding, started by AGICOA against cable operators in Israel, is pending a Supreme Court's cassation decision (outside AGICOA's file) that will rule whether or not copyright exists in cable retransmission of satellite broadcasts. If the ruling is positive, AGICOA's chances to win its own case would be substantially better.

Oct. 02 - legal proceeding re-initialised
The legal proceeding opposing AGICOA to the Israeli cable operators and which has been suspended due to some parties' bankruptcy, will be re-initialised during a new audition in November.

Apr. 02 - unauthorized retransmissions
Early 2000, after having tried to negotiate a licensing agreement, AGICOA has started legal actions against cable operators in Israel who have been retransmitting content without the authorization of rightsholders. A recent, unrelated decision by the Supreme Court holding that cable retransmissions are subject to copyright protection may help the producers' cause.

Proceedings have been temporary stopped due to two defendants' bankruptcy. AGICOA pleaded to continue, underlining no creditors settlement were concerned but an intention to establish rights. No decision has been rendered yet.

 

Latvia
Sep. 06 - agreements renewed
Current global licensing agreements covering public TV channels from different countries and several commercial German channels have been renewed in Latvia.

Negotiations are under way to expand the agreements to include other channels retransmitted in the country.

The royalties collected in Latvia will be allocated to a mark-up distribution.


Feb. 06 - agreements extended
Most existing global licensing agreements were successfully extended for the years 2005 to 2007 in Latvia.

July 04 - satisfactorily
Renewed in 2002, the global licensing contract is running satisfactorily.

 

Lithuania
Sep. 06 - agreements renewed
Current global licensing agreements covering public TV channels from different countries and several commercial German channels have been renewed in Lithuania.

Negotiations are under way to expand the agreements to include other channels retransmitted in the country.

The royalties collected in Lithuania will be allocated to a mark-up distribution.


Feb. 06 - agreement extended
An extension of the existing licensing agreement was signed for the next three years with LKTA, the biggest Lithuanian cable operators' umbrella organization.

July 04 - satisfactorily
The global licensing contract is running satisfactorily.

Dec. 02 - smoothly
The global licensing contract has been renewed and the agreement continues to run very well.

 

Luxembourg
Mar. 07 - audiovisual state of the art

A new exemplary agreement will come into effect in Luxembourg on January 1, 2008. It will
make it possible for this country, which often leads the way in the audiovisual field, to implement
a global digital conversion, in a consensual manner, respecting the interests of all the players.

The legal foundations of copyright in the digital age do not change but certain procedures nevertheless need to be adapted to the new environment. The retransmission capacity being much higher, tariffs can no longer be negotiated with cable operators on a channel- per-channel basis. Instead, truly general licensing contracts are needed that offer entire groups of channels for a given type of Rightsholder.

The first contract of this type was negotiated in Luxembourg and involved all the categories
of Rightsholders (producers, authors and broadcasters). Every negotiating party, in particular ALGOA (the AGICOA Partner) and the Luxembourg authorities, deserves to be praised for reaching this exemplary agreement. It is a clear demonstration that scrupulous respect of intellectual property and technological progress, far from being necessarily opposed, can be complementary in contributing to a safe and harmonious development of audiovisual broadcasting.

Macedonia
Sep. 06 - agreements renewed
Current global licensing agreements covering public TV channels from different countries and several commercial German channels have been renewed up until the end of 2007. Negotiations are under way for 2008-2010 and to expand the agreements to include other channels retransmitted in the country.

The royalties collected in Macedonia will be allocated to a mark-up distribution.


Mar. 05 - 2004 collection started
In 2004, AGICOA started legal proceedings against those cable operators who stopped honoring the global licensing agreements signed back in 2003. Only half of the expected revenue had been collected but after some settlement agreements the trend is upwards.

July 04 -
Global licensing agreements with almost all cable operators were concluded in December 2003. However, collection run into difficulties as the cable operators refused to communicate to the local collecting society - ZAMP - the data needed for the collection, i.e.: the retransmitted TV channels and the number of households. As a result, no money has been collected so far.

Aug. 03 - agreement expected in the fall
As the national Copyright office had first refused to grant to the local CISAC society ZAMP the license to operate in the field of cable retransmission, the conclusion of the global licensing agreement had been delayed.

ZAMP filed a second application and finally got the license. The global licensing agreement is therefore now expected to be concluded during the forthcoming fall.

 

Montenegro
Dec. 07 - negotiations under way
Negotiations are under way in Montenegro between AGICOA and several cable operators and one ADSL operator.

 

Northern Ireland
Nov. 07 - satisfactory state of affairs
The situation remains satisfactory in Northern Ireland where the global licensing agreement has been renewed.

Oct. 02 - licensing agreement renewed
The cable licensing agreement between AGICOA and NTL, which had been compromised due to NTL various financial problems, has been successfully renewed after the Irish cable operators' recovering.

 

Norway
Dec. 07 - satisfactory state of affairs
Royalties are collected in a satisfactory manner in Norway.

Feb. 06 - satisfactorily
The global licensing contract is running satisfactorily.

July 04 - smoothly
Collections in Norway are running smoothly.

 

Poland
Dec. 06 - fifth position
Poland has rapidly become one of the more promising markets for AGICOA's Rightsholders. This country occupies the fifth position for the Group's collections in 2006.

A licensing agreement with cable operators which is due to expire at the end of 2007 is being renegotiated to obtain an extension. The agreement with Cyfra + for the satellite platform is also negotiated with the same objective in mind.


Mar. 05 - collection started
A final agreement has been concluded with OIGKK, the organization representing the Polish cable operators and collections have finally started in Poland. AGICOA expects to collect about 3 million euro in 2005.

July 04 -
Early 2003, AGICOA, together with SFP/ZAPA and the International broadcasters of EBU and VG Media launched legal proceeding for payment of cable retransmission royalties against Aster City, one of the main cable operators in Poland. No court hearing took place so far and the first instance ruling is not expected before the end of 2004.

In the meantime, an interim agreement has nevertheless been concluded with the umbrella organization of Polish cable operators, OIGKK, but the negotiations did not lead to any final licensing agreement.

In parallel, AGICOA and its national partner, SFP/ZAPA, decided to sue four other cable operators including UPS which target neighbours 1 million subscribers.


Aug. 03 - transitional agreement
The first instance ruling in the legal proceedings for payments of cable retransmission royalties launched by AGICOA against Aster City is expected by the end of 2003.

AGICOA's efforts to unite Polish collecting societies failed. However AGICOA and SFP/ZAPA concluded a transitional agreement with the umbrella organization of Polish cable operators OIGKK. Apart from a small remuneration, the transitional agreement sets up the schedule of negotiations until the end 2003.


Mar. 03 - negotiations with cable operators
AGICOA, together with SFP/ZAPA and the international broadcasters of EBU and VG Media had launched legal proceedings for payment of cable retransmission royalties against Aster City. The first instance ruling is not expected before the end of 2003.

In the meantime, AGICOA and its parties will meet with a delegation of Polish cable operators to negotiate the ground of a licensing agreement covering a maximum scope of retransmission rights. An appointment with some Ministry of Culture representatives is also forecasted to warn them on the continuous pirating of Polish cable operators.

In parallel AGICOA will try to gather some of the major numerous local collecting societies in order to discuss some tariffs' adjustment commercially viable both for the cable operators and for the rightsholders.


Oct. 02 - claim for remuneration
After a first success in the litigation against ASTER CITY (one of the major cable operator in Poland) which obliged them to disclose economic parameters, AGICOA, together with a wide range of broadcasters, started a claim for remuneration against ASTER CITY.

May 02 - legal action
AGICOA and its Polish member ZAPA (Association of Audiovisual Authors and Producers), represented by Jacek Bromski, President, have signed a cooperation agreement last May in Cannes. The contract settles the frame of future distributions coming from Polish cable operators.

In the same time, as all attempts to arrive at a contractual license have failed, AGICOA, ZAPA, EBU and VRPT (broadcasters) commonly decided to bring legal action against ASTER CITY, one of the main Polish cable operators.

 

Portugal
May 06 - renewal and negotiations
AGICOA and its local partner GEDIPE have just renewed for a period of five years their collection agreement with CABOVISAO, the largest cable operator in Portugal.

At the same time, negotiations are under way that pertain to ADSL retransmissions in this country.


Feb. 06 - smoothly
Collections in Portugal are running smoothly.

Dec. 04 - first distribution
The collection agreements signed in 2003 with the two largest Portuguese cable operators led in December 2004 to the first distribution for this territory. Three additional licensing agreements with smaller cable operators have recently been concluded.

July 04 -
GEDIPE, AGICOA's Partner in Portugal, signed in 2003 collection agreements with the two local cable operators CABOVISAO and TV CABO. AGICOA expects to run the first Portuguese distribution in the course of 2004.

June 03 - first collections
Whereas first collections from CABOVISAO have started, next round of negotiations with TV CABO will take place late September.

Apr. 03 - new partnership
Local producers' collecting society GEDIPE and AGICOA entered into a cooperation agreement.

GEDIPE recently negotiated its first licensing agreement with the second largest Portuguese cable operator CABOVISAO to start collecting in the current year.

TV CABO, the main national cable operator accepted in principle to also acquire cable retransmission rights. Negotiations should start in May.

 

Retransmission in hotels
Feb. 08 - Europe-wide
The Court of Justice of the European Communities recently set that the retransmission of a television broadcast in a hotel is a type of public communication and is thus subject to copyright. Encouraged by this ruling, AGICOA has widened and intensified its license negotiations with hotel associations, groups, chains as well as independent hotels throughout Europe.

Sep. 07 - confirmation of the mandate given to AGICOA
A December 2006 ruling by the Court of Justice of the European Communities prompted AGICOA's Executive Committee to reiterate the mandate given to the Association to include hotels when negotiating the collection of royalties.

The ruling stipulates that hotel television broadcasts constitute public communications. From the perspective of collective management, such communications are subject to copyright laws. It is up to the authors to authorize these communications and to collect the corresponding royalties. It should be emphasized that the ruling pertains to integral, simultaneous, continuous and unaltered retransmissions of television channels and does not include pay-per-view services.


Dec. 06 - hotels subjected to copyright laws
SGAE, the Spanish collecting company serving Spanish authors and editors, has interrelated Rafael Hoteles SA in the Court of Justice of the European Communities. SGAE argued that any type of offering of an audiovisual work to a public, such as in a hotel, constitutes an independent communication event. Copyright laws thus apply when delivering authorizations for this type of communication, which may be a for profit activity. In the case of Rafael Hotels for instance, the television signals are offered as a fee-based supplement.

By enacting the view that a television broadcast in a hotel is a type of public communication, the Court's ruling sets an important precedent for the collective rights management.

 

Romania
Dec. 06 - first distributions
The first distributions for Romanian retransmissions took place in 2006 and should continue at the same rate in the next year.

Moreover, the decree setting a ridiculously low ceiling on royalties has been abolished. AGICOA and its Partners are thus in a position to negotiate new rates starting 2008.


Feb. 06 - arbitration in view
While cable operators are honoring their obligation to pay cable rights, within the ridiculously low threshold of 2% set-up by the Romanian Copyright act, the split of this amount amongst the various collecting societies, including AGICOA's national partner company UPFAR/ARGOA is being subject to virulent negotiations and arbitration proceedings.

To bypass the problem, UPFAR/ARGOA invited the cable operators to conclude a new licensing agreement. As the negotiations failed, ORDA the Romanian copyright office stated in January 2006 the start of arbitration.


Sep. 04 - new member
The Romanian Union of film and audiovisual producers - UPFAR (Uniunea Producatorilor de Film if Audiovizual Din Romania) - became Member of AGICOA after its admission by the Executive Committee on September 28.

July 04 -
After accepting the arbitration that fixed producers shares, ACC (the Romanian cable operators' organization) attacked the ruling before Court in 2003, thus blocking all ongoing licensing agreements.

The situation has not progressed since 2003 and AGICOA is studying with DACIN SARA (its local partner and copyright society) and other national bodies the possibilities to progress with cable collection in this country.


Aug. 03 - ongoing licensing agreement blocked!
After accepting, late 2002, the arbitration that fixed producers shares, ACC (the Romanian cable operators organization) attacked the ruling before Court, thus blocking all ongoing licensing agreements.

The Supreme Court's decision is expected to be ruled by end year. In the meantime, AGICOA expressed its concern to the Romanian authorities while strongly condemning the situation.


Nov. 02 - 3% on cable revenues
ACC (the Romanian cable operators' organization) and AGICOA accepted an arbitration that fixed a tariff equivalent to 3% of cable-operators revenue for producers and audiovisual authors’ rights. This represents an important step for AGICOA in Romania, the next one being to sign licensing contracts with the cable operators and start collection.

Oct. 02 - mediation

AGICOA member and partner, DACIN SARA (copyright collecting society for audiovisual works) has started mediation proceedings with local cable operators. In parallel AGICOA has made contact with the copyright state office also in view of collecting in this territory.

 

Russia
Dec. 07 - search for a dialog
AGICOA and RAO, the local CISAC society (International Confederation of Societies of Authors and Composers) are searching for a dialog with the Russian cable operators and legal authorities to build a solid legal basis for the protection of copyright in this country.

 

Serbia
Dec. 07 - renewal
The current global licensing agreement in Serbia has reached its term. It has been renegotiated in cooperation with the EBU and VG Media (the broadcasting organizations) and it will continue to contribute to AGICOA's mark-up distributions.

Feb. 06 - regular
Collections in Serbia continue quite regularly and are contributing to mark-up distribution.

Dec. 04 - a new country of collection
Several licensing agreements have been signed towards the end of 2004 and Serbia Montenegro can now be added to the list of AGICOA's countries of collection.

Sep. 03 - contacts undertaken

In co-operation with the broadcasters' organizations EBU and VGMedia in various Eastern European countries, AGICOA has recently approached the main cable operator Serbia Broadband and the cable operators' umbrella organization YU Cable.

Local collecting societies have also been contacted to participate in the global licensing agreement that could be developed.

 

Slovak Republic
Dec.07 - degradation
The situation has not improved in Slovakia where several cable operators persist in their failure to pay the royalties due. SAPA (the Association of Slovak Audiovisual Producers and AGICOA's partner) pursues the legal action taken against the offenders.

The amounts that are nevertheless collected continue to be included in AGICOA's mark-up distributions.


July 05 - legal proceedings
SAPA (the Slovak producers' society and AGICOA's Partner) started several proceedings against those cable operators that stopped paying agreed upon royalties. The court ruling is not expected before end year.

July 04 -
After the conclusion of a co-operation agreement with the Slovak producers' society, SAPA, and the conclusion of the first licensing agreement with cable operators, collections for the year 2003 have started. However some operators took advantage of the fact that legal discussions are still going on to decide which society (between SAPA and the other competing collecting entity) are entitled to collect cable rights in the Slovak Republic, to postpone their payments.

Backed up by AGICOA, SAPA started several proceedings against those cable operators.


Sep. 03 - negotiations
After the recent signature of their co-operation agreement, SAPA and AGICOA have positive hopes to start collection in 2003 with the cable operators' umbrella organization SAKT.

Similar negotiations with UPC, the biggest national cable operator are underway.


July 03 - a door opens in Central Europe
AGICOA has signed a cooperation agreement with the very new collecting society SAPA. This agreement is opening Central European's doors to AGICOA.

Apr. 03 - potentials under study
SAPA, the Slovak producers' neighboring rights collecting society and AGICOA are studying cooperation agreement potentials in order to start cable collections in 2003.

 

Slovenia
Dec. 07 - a positive outlook
The progression of collections in Slovenia is very satisfactory and the global licensing contract that has been renewed for a period of three years provides for increasing tariffs. An additional agreement has been reached for channels retransmitted in Slovenia and that are not yet included in the global license.

A specific distribution that is not part of a mark-up will probably take place in 2008.

A licensing agreement has been signed with DEUKOM, a satellite operator based in South Africa for retransmission of German channels in Lesotho, Mozambique, South Africa, Zambia and Zimbabwe,

Royalties collected by AGICOA shall be allocated during the next distribution.

 

Spain
Nov. 04 - new cooperation agreement signed
A new cooperation agreement has been signed with EGEDA, the Spanish collecting society. This agreement perpetuates a long standing business relationship and officializes EGEDA's partnership in the AGICOA Group.

Oct. 02 - first distribution
EGEDA, AGICOA member and partner has started the first ever distribution regarding cable rights on the Spanish territory. Although the amounts are still limited, this nevertheless represents an important step forward for the related rightsholders.

 

Sweden
Nov. 07 - stable
In Sweden, the situation remains stable and royalties are collected regularly.

Feb. 06 - satisfactorily
Collections are running satisfactorily.

July 04 -
Collections in Sweden are running smoothly.

Sep. 03 - increased rate
Copyswede, the umbrella collecting society that negotiates copyrights agreements in Sweden, will apply for Q3'03 an increased rate on the main local channels. Good news for all the rightsholders collecting in this country.

June 02 - renewal of cooperation agreement with FRF in Sweden
It is Per-Erik Walin who signed for FRF (Filmproducenternas Raettighets Foerening) in Sweden this new cooperation agreement between his company and AGICOA.

The agreement is consolidating AGICOA's cooperation with its Swedish member which is collecting and distributing remuneration in its territory.

 

Switzerland
Nov. 07 - stable
In Switzerland, the situation remains stable and royalties are collected regularly.

Collections are running satisfactorily.

Sep. 02 - fortieth member
Swiss collecting society, SUISSIMAGE has become AGICOA fortieth member when admitted by the Executive Committee as institutional member last September.

 

The Netherlands
Dec. 07 - the digital era

The negotiations surrounding the global digital conversion in the Netherlands resulted in the signing of an additional contract covering 120 channels.

The legal foundations of copyright in the digital age do not change but certain procedures nevertheless need to be adapted to the new environment. The retransmission capacity being much higher, tariffs can no longer be negotiated with cable operators on a channel- per-channel basis . Instead, truly general license contracts are needed that offer entire groups of channels for a given type of Rightsholder.


Feb. 06 - one more year

The BUMA/AGICOA/SEKAM global licensing agreement has been extended until December 31, 2006 with an increase of 7.5%.


July 05 - extension until October 2005

The Dutch cable operators, represented by VECAI, have cancelled the existing global licensing agreement for the end of March 2005. The talks to re-establish the situation did not come to any conclusion and AGICOA started litigation against the cable operators. In a still pending intermediary injunction lawsuit, the court extended the application of the general licensing agreement until October 2005 and called for another hearing in September.

Cable operators - who launched an appeal against this ruling - would like to substitute to the global contract some channels, such as national ones and require that AGICOA negotiate directly with the broadcasters.


Apr. 05 - new member

Fintage House, an independent financial service company in the global entertainment industry (Film, TV, Music, Fashion and Sport) became an AGICOA Member.


Mar. 05 -

The Dutch cable operators, represented by VECAI, have cancelled the existing global licensing agreement for the end of March 2005. The talks did not come yet to a conclusion and need to be continued. In parallel litigation has been started against the cable operators.


July 04 -

The Dutch cable operators, represented by VECAI, have cancelled the existing global licensing agreement for March 31, 2005. They expressed their desire to substitute to the global contract, a series of separate contracts per broadcasting entity.

AGICOA and its local partners have already started negotiations with the cable operators to reestablish the situation.


Sep. 03 - negotiations for more channels
Ongoing negotiations are taking place between the Dutch association of cable operators VECAI and Rightsholders' groups, regarding a new global licensing agreement that would cover additional TV channels.

 

Turkey
Dec. 07 - fighting for copyright
The legal action taken by AGICOA against two cable operators is being pursued.

Nov. 07 - new AGICOA member

SE-YAP, the Turkish Movie Producers Association has joined the ranks of AGICOA's Members.


Feb. 06 - statement of claim

After several unfruitful attempts to conclude a global licensing agreement in Turkey, AGICOA has started legal proceedings against three cable operators and filled in a statement of claim on the basis of piracy.


Aug. 05 - legal proceedings

Since 2003 AGICOA has been trying to establish contacts with the local cable sector in Turkey. After several attempts to conclude a global licensing agreement with the main cable operator failed, AGICOA has decided to prepare litigation on the basis of piracy.

Indeed the Turkish new copyright act states that cable retransmission of copyrighted works contained in TV programs is subject to copyright, therefore cable operators are clearly pirating a/v work broadcast on Turkish and some European TV channels.

AGICOA evaluates the yearly cable royalties to between one and two million EURO. In the context of the imminent litigation and to officially back-up its action, AGICOA has contacted its Rightsholders to get their confirmation that it is duly mandated by the film rightsholders to enforce the Turkish cable retransmission rights in Turkey.

 

Ukraine
Dec. 07 - a significant slow-down in collections
AGICOA and UACCR, the local CISAC society (International Confederation of Societies of Authors and Composers) are attempting to renew the dialog with Ukrainian cable operators and legal authorities to build a solid legal basis for the protection of copyright in this country.

Apr. 05 - to extend the licensing agreement

In order to extend the licensing agreement to new TV channels and to new cable operators in Ukraine, AGICOA sought the assistance of its Member, the Producers' Guild of Russia, to organize a series of meetings with various state authorities, collecting societies, the main cable operator and the umbrella organizations. Negotiations are planned to continue early 2006.


Aug. 03 - licensing agreement
Thanks to VG Media (collecting society mostly representing German commercial broadcasters) with which it collaborates in various Eastern countries, AGICOA concluded its first licensing agreement with two cable networks in Ukraine.
