A rightsholder


Definition of a rightsholder: an independent producer or his/her assignee owning cable or similar retransmission means' rights on audiovisual works. He/she can be a natural person or a legal entity.

A rightsholder, for legal and practical reasons, cannot exercise his or her rights individually vis-à-vis cable operators. He or she must make use of the services of a collecting society.

As a neutral and non-profit institution, AGICOA acts in various countries to collect and to distribute the payments of royalties to the producers of audiovisual works and/or their rightsholders. In some countries, where free negotiations have been substituted by compulsory rulings, AGICOA claims and collects remuneration.

Whenever there is retransmission of an audiovisual work by cable or by similar means, a remuneration may be due. It is AGICOA's task to obtain payment of these royalties and to redistribute them to the rightsholders entitled thereto, after proper data processing based on TV channels reports of the countries involved.
