Who is remunerated by AGICOA?

Independent producers or their assignees owning cable or similar retransmission means' rights on audiovisual works.


What categories of works are remunerated by AGICOA?

Audiovisual work that consists of fixed pictures linked to each other suggesting movement, whether or not accompanied by sound, prone to be made visible and, if accompanied by sound, prone to be made audible. When declaring your work at AGICOA you will be requested to specify its type and its kind as per the indicative definitions here below:

Type definitions
  • SH: Short film - a single audiovisual work which is not a part of a serie and lasts less than 50 minutes.
  • SE: Serie or serial - any audiovisual work of a repetitive nature and consisting of seasons and/or episodes whatever the duration of each of these may be.
  • FF: Feature film - an audiovisual work of 50 or more minutes, originally intended for primary exploitation by movie theaters (or which has been exploited in such a way).
  • TF: Tele feature - an audiovisual work originally produced for television, and not intended for exploitation by movie theaters. Its duration is of 50 or more minutes.
Kind definitions
  • FI: Fiction - work that consists mainly of invented narrative elements, with the exception of animation.
  • AN: Animation (cartoons, puppets).
  • NF: Non fiction - work that consists mainly of facts (documentary, talk show, reality show, etc...).

What do you have to do to be remunerated by AGICOA?

Register your details


At your very first registration and for any contact updates, send AGICOA all the necessary details to allow future communication and royalties transfers. Original specimen of signatures are necessary to authenticate exchanges.

Declare your works and rights                                                                                                                                                                   


AGICOA has developed for your convenience three declaration modes. You may select the most appropriate to your environment and needs.

  • IRRIS: Online services to declare, update and/or query your works and rights as well as to look at your related remunerations.
  • WRI: Electronic import of Works and Rights Information between your Company's database and AGICOA's to declare and/or to update your works and rights.
  • Paper forms: Paper declaration forms that you will fill in from your computer, print and send back to AGICOA.

Accuracy and completeness of data is of utmost importance to optimise matching between a work and its potentially corresponding broadcasts resulting in subsequent remunerations.

IRRIS, our international electronic database contains at present over 630,000 titles of audiovisual works belonging to Rightsholders from various countries. This unique database is managed on a confidential basis, though at any time you may consult your data with IRRIS, the online services. Ask for access now.

Upon receipt of your declarations, AGICOA will check if all mandatory information has been given and is understandable. If this is the case, your data are registered. This is confirmed to the rightsholder who receives a unique AGICOA rightsholder number and declaration numbers corresponding to the declarations of the works.

Note that you may declare your works and rights either:

  • prior to the retransmission of the work;
  • after the retransmission of the work.

What does AGICOA for you?                                                                                                              
Allocation of a single point of contact within AGICOA

AGICOA's concern is to grant you the best possible service by working closely to your needs and expectations. For that reason, you will be assigned a personal representative who will be your point of contact whenever you need assistance.


Potential multiple declarations announcement

A work may have been declared by more than one rightsholder and these declarations may not be compatible with one another; that's what AGICOA calls a conflict. AGICOA will contact each one of these rightsholders and inform them of the situation and will offer its help to solve the conflict.


AGICOA claims and collects your royalties


As a neutral and non-profit institution, AGICOA acts in various countries to collect and to distribute the payments of royalties to the producers of audiovisual works and/or their rightsholders. In some countries, where free negotiations have been substituted by compulsory rulings, AGICOA claims and collects remuneration.

Whenever there is retransmission of an audiovisual work by cable or by similar means, a remuneration may be due. It is AGICOA's task to obtain payment of these royalties from the operators and to redistribute them to the producers entitled thereto, after proper data processing based on TV channels reports of the countries involved.

AGICOA distributes your royalties to you


The royalties payable to you are calculated on the basis of non-discriminatory, objective criteria such as the duration of the work.

Are remunerated automatically for cable retransmission, if the related work has been declared with AGICOA:

For broadcast year 2005 and the following ones:

  • Audiovisual works of 1 minute or more, broadcasted on channels for which allocated royalties are sufficient for automatic distribution.

For broadcast year 2004 and the preceding ones:

  • Audiovisual works of 6 minutes or more, broadcasted on channels for which allocated royalties are sufficient for automatic distribution.

Once a broadcast has been identified (i.e. if it matches with a work declared with AGICOA), the remuneration generated by the retransmission is calculated.

Payments are done via international bank transfer only, in the national currencies of the country of collection.


Final distribution                                                                                                                                               

Generally three years after the first distribution, funds never claimed are distributed on a pro rata basis to the Rightsholders who have already received prior payments, for the territory and period concerned.

From this moment, there is no possibility to claim payment for that territory and period. Only money blocked in relation to pending conflicts will be distributed after resolution.

Payment documentation

Each time AGICOA generates a payment, two sets of documents are issued to the Rightsholder:
  • Account Statement: indicating the global remuneration paid to you;
  • Journal: detailing each cable retransmission paid to you.
